Terms of Service

1. Agreement

These Terms govern your subscription to OwnCrew Review Reply ("the Service"). By subscribing, you agree to these Terms. If you don't agree, don't subscribe.

2. The Service

OwnCrew Review Reply is a managed service operated by a Vancouver-based independent founder. We:

  • Monitor your Google Business Profile reviews
  • Draft replies using AI (Anthropic Claude), tuned to your stated brand voice
  • Email you drafts within 24 hours of a new review
  • Post approved replies to your Google Business Profile on your authorized behalf
  • Send weekly performance reports
  • Flag high-sensitivity reviews (food safety, legal threats, employee disputes) for your direct decision before any public reply

The Service requires you to grant OAuth access to your Google Business Profile (read + write reviews). You can revoke access at any time via your Google Account settings.

3. Eligibility

You must be at least 18, legally authorized to manage the business you connect, and not located in a country sanctioned by Canada or the United States.

4. Pricing & billing

  • Standard price: USD $99 per month, billed monthly via Stripe
  • "Founding 5" customers (first 5 paying subscribers): price locked at $99/month for 12 months regardless of future price changes
  • Billing recurs automatically until you cancel
  • Prices in USD; your card may incur foreign exchange fees from your card issuer

5. Refund policy

First-month full refund: if you're unhappy with the Service within 30 days of your first charge, email us and we'll refund your first month in full. Refunds are processed via Stripe within 5-10 business days.

After 30 days, charges are non-refundable. You can cancel anytime to stop future charges (see Section 7).

6. Service guarantees and limitations

What we promise:

  • Reply drafts within 24 hours of a new review under normal operating conditions
  • Human-reviewed drafts before sending (AI does not auto-publish)
  • High-sensitivity reviews escalated to you before any reply

What we don't guarantee:

  • That replies will improve your Google ranking or review score
  • That AI drafts will always match your preferred tone perfectly (we iterate based on your feedback)
  • 24-hour replies during founder unavailability (illness, travel, force majeure) — we'll notify you and may extend to 48 hours
  • That Google Business Profile API will remain available (we depend on Google's policies and uptime)

7. Cancellation

You may cancel at any time:

  • Via the Stripe customer portal link in your billing emails
  • By emailing owncrewdemo@gmail.com
  • By revoking OAuth access in your Google Account (this immediately stops our access to your reviews)

Cancellation takes effect at the end of your current billing period. No partial-month refunds after Section 5's 30-day window.

8. Your responsibilities

You agree to:

  • Provide accurate information during onboarding
  • Hold legitimate authority over the Google Business Profile you connect
  • Comply with Google's Business Profile guidelines and applicable laws when approving replies
  • Not use the Service to post fake reviews, misleading content, or content that violates third-party rights
  • Keep your email and contact info up to date

9. Acceptable use

You may not use the Service to:

  • Post defamatory, harassing, or illegal content
  • Impersonate another business or person
  • Manipulate Google review scores or rankings through deceptive means
  • Reverse-engineer, resell, or sublicense the Service

Violations may result in immediate termination without refund.

10. Google services

The Service depends on Google Business Profile API. Your use of Google services is subject to Google's own terms (Google Terms) and the Google API Services User Data Policy. We are not affiliated with or endorsed by Google.

11. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that AI drafts will be free of any inaccuracy.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST CUSTOMERS, OR DAMAGE TO REPUTATION FROM ANY REPLY POSTED THROUGH THE SERVICE.

13. Indemnification

You agree to indemnify and hold harmless OwnCrew, its founder, and contractors from claims arising from (a) your violation of these Terms, (b) your violation of any third-party right, or (c) content you approve for publication through the Service.

14. Changes

We may update these Terms. Material changes will be emailed to active subscribers at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

15. Termination

We may suspend or terminate the Service to you immediately, with or without notice, if you breach these Terms or if continued service becomes commercially impractical. We will refund any prepaid unused amount on a pro-rata basis if termination is not for cause.

16. Governing law

These Terms are governed by the laws of British Columbia, Canada, without regard to conflict-of-laws principles. Disputes will be resolved in the courts of Vancouver, British Columbia, unless otherwise required by your local consumer protection laws.
